Washington, Jun 22 (Prensa Latina) Defense lawyers of Cuban antiterrorist fighter Gerardo Hernandez presented a new legal action at a court in south Florida, the International Committee to Free the Five stated today.
Jurists Tom Goldstein and Martin Garbus, defend attorneys of Hernandez, filed a motion at the Southern District Court of Florida, through his local attorney Richard Klugh.
The demand request an oral hearing, as well as the Court orders the government to deliver some documents and other materials in its possession and they have not been revealed during the legal process, through a procedure known as Discovery.
The motion was presented on June 6 and is part of the collateral appeal process begun on June 14, 2010, the source stated at a release in which Prensa Latina had access.
The legal exigency is based on the right the petitioner and his co-defendants have of learning the goal of the negative publicity campaign against the Five, financed by the government with the intention of assuring they were pleaded guilty.
Its purpose is to achieve, through questionings, presentation of documents, testimonies, and legal summons, all the necessary evidence, so it is examined by the court during a hearing and prove the sentences should be annulled, the committee stated.
The Discovery request seek to establish a total goal of the issue identifying all journalists and mass media that received pays by the United States and later published false, hostile, inflammatory and damaging statements about the petitioner and his co-defendants.
The request includes 84 individuals connected to inflammatory press coverage relating to this case, seven TV stations, and 13 radio stations, the International Committee to Free the Five said.
Martin Garbus is recognized in the United States as one of the major litigant attorneys in national and international cases. His long professional career includes the defense of countless cases, even in the Justice Supreme Court, some of them have set legal precedents.
Hernandez, along with Ramon Labañino, Antonio Guerrero, Fernando Gonzalez and Rene Gonzalez, known internationally as the Five, were sentenced in the United States for monitoring anti-Cuban terrorist organizations in this country.
The five Cuban antiterrorist fighters were detained on September 12, 1998. Rene Gonzalez was released from prison on October 7, 2011, after having completed his prison term. He was forced to remain in U.S. territory for three more years under supervised release.
